  • Get a home inspector to do a mold test, and have the inspector write up the reasons why the mold happened. If it's due to a leak or the shower above you, it's definitely not your fault, so send a copy to your landlord, and ask whether he'd rather fix the damage or go through the abatement process. If he has trouble making up his mind, mention that you have the health department's fax number and would be happy to bring them into the loop. Also, regardless of whether you file for abatement, tell him that you'll be deducting the cost of the inspector and the drywall contractor from the following month's rent. Send the receipts so he knows you're not making the charges up. You'll get your fixes and nothing more will be said. Disclaimer: I'm not a lawyer but have been a landlord for years.
