Defense attorneys must be allowed time to present a defense for their clients, before court. if new charges are included in open court, the defendants rights would be violated. So no, a judge cannot add additional charges in court.
  • They can add anything they want to add to railroad anybody. I learned that the hard way. I completely trusted the law until I got a traffic violation and went to court just to find out I had no rights at all. And I was being reilroaded. I fought that for over 2 years and finally won. the law and courts are totally in favor of the rich man and if you are middle class or poor they are going to hang you as much as they can.

A judge can also hold a person in contempt (which is not a charge). However, a judge can conform an information or complaint to the evidence before the court.
