What percentage of lawsuits settle before trial? What percentage settle within 48 hours of a trial, or "on the steps", so to speak?

That is a difficult question to answer. Only 2% of all lawsuits make it to trial. However, not all of the other 98% actually settle. Often times the filing is just used as leverage, even though the plaintiff never intended to actually pursue the case in court. In addition, many disputes settle before the lawsuit is actually filed.
