What does it say on your lease about it? It would seem that you are supposed to pay for February even if you aren't there for the full month. Because you are not vacating before the end of January, you're going to be in the apartment for part of the month of February. That was the case for me (though, I am in a different state).

I own a property in New Hampshire and if my tenant was in your situation I would charge a pro-rated amount.... 1/3 month's rent. The laws in Maine and your lease may dictate otherwise.

I am not sure exactly, but I know when I moved into my current apt, I did not want to wait until the 1st of the following month. My landlord prorated the "extra" days I would be here. I moved in on like the 26th or 27th of June, and paid just a little for those days. I don't see why you couldn't work something out and do the same leaving. I would read your lease and see if it mentions anything. If you do not pay the full amount, and he wants you to, more than likely he will take it out of your deposit. Good luck!

My Landlord says that I have to pay for the full month. 'I have a tenancy at will' since I'm month to month. In my original lease I can't see where it states that I have to pay the full rent. It says for extended stay if the lease is not re-signed, "This month to month tenancy shall be governed by this written lease and shall not be considered a "tenancy at will"; therefore, State Law regulating a tenancy at will shall not be applicable". (I'm the one who asked the question, by the by)
