  • You should really consult a bankruptcy attorney. When you file, you can't wipe out just a portion of debt, such as credit card debt. Bankruptcy is across the board and much harder to declare than a few years ago. The spouse would be affected if he/she was a joint account holder on the credit card accounts, or a co-signer/joint holder of any other account, loan, etc. The spouse is also affected in that they will be assuming the good credit standing for future transactions cush as home and car purchases, loans, etc.
