Can a couple come from another state to Montana and do a common-law marriage? How long would they have to stay in Montana to accomplish this?

    Why not just get married? There is no time limit in Montana, but you do need mutual consent. Thus, unlike other states, you cannot unwittingly become common law married in Montana. Also, you need to be in Montana long enough to gain a reputation in the community as being married. And a common-law marriage has no real affect until you go to court and get adjudicated as a married couple.

    Which brings me back to my original question. Why not just get married? It is quicker and cheaper that way.
