  • Wow...this is a hard one. I'm not sure what your parent's estate has to do with the situation. I think you need to see an attorny...you MAY be able to evict him (but I kind of doubt it) and sue him for what he owes you so far on the house...but that won't get his name off of it or get him to pay half of the future mortgage payments. You are in a tough situation...I feel for you that your brother would put you in this situation.
  • If he owns 1/2 of the house, he has as much right to live there as you do. I'm confused about how an estate was settled without selling the house, or at least paid off. When I settled my parents estate, all the creditors had to be paid in full, including the mortgage. We had to sell the house to pay it off.
  • i dont see how you can evict a co-owner.
