  • If you refuse a breathalyzer you will lose your license for 1 year. If you get a good lawyer you might get the DUI charges dropped. The money you spend on an attorney will be a lot cheaper in the long run. To avoid all of this, just don't drink and drive.
  • If you look at the back of your drivers' license it says "Operation of a motor vehicle constitutes consent to any sobriety test required by law". If you refuse, you are then obstructing justice. Not a good thing.

  • Well it depends state to state. Really heard in some states, its better to refuse. At least lawyers suggest that. But why risk it? Get a designated driver....or just stay home. trust me, worse things can happen, then risk getting pulled over. ...ask the guy who was put in jail for killing my best friend, cause he was drinking and driving.   • Don't refuse but request a blood/alcohol test. They are supposed to take you to the police station or hospital ER to draw your blood. It takes longer and more alcohol will be out of your system. You are not refusing to comply but you are buying time. Better yet~~~don't drink and drive the life saved might be mine!!
  • In the UK they treat this as the same as drink driving by refusing you are basically admitting guilt, why else would you refuse. The punishment is the same as drink driving the record on your licence will be coded differently as they have no measurement to charge you with drink driving. In the UK they treat this as serioulsy as drink driving if not more so because it fustrates them when you wont comply.
  • in my state you can refuse a field sobriety or breathalyzer...of course then you get to ride to the station and take a blood test...so either way you go to jail. You might as well just take the breathalyzer and who knows maybe you will get a cop who's shift is almost over and he'll go light on you.
  • its the best thing you can do.. i got a DUI before and this is what my lawyer told me. if it ever happens again, refuse the breathalyzer, and refuse the roadside sobriety test, this way, when you go to court, there will be no evidence, and itll be much easier to get off with a lesser charge like wreckless driving or something.
  • It depends where you live. Where I live refusal to give a breath sample carries the same penalty as being over the limit.
