What law would this be in violation of? No, it's not "illegal" as all things aren't equal. One, the boss, is a more valuable employee and more difficult to replace. Also, I'm sure their employee files are quite different. Companies are often willing to work with a long term employee more than one who is a relatively newer employee. What it comes down to is that the company is allowed to hire and fire at will. There is "cause" with a dirty drug test. Whether they want to take another chance with a particular employee or not is entirely up to them.

The place of work where this happened was a coal mine. The employee had been there 3 years. The boss had only been there 1 year. The employee was a union member, and the boss just worked for the company, if any of this helps. Thanks for your answers so far.
