Is it legal to be forced to be salary so they can use a gov. scale to calculate overtime? Carpenter working salary

If you are in the US the Fair Labor Standards act would most likely come in to play. If you are in a position that by there rules should be hourly, like being a carpenter, they can't make you salaried.
