  • I am unfamiliar with the laws in the State of South Carolina, but most States will require delivery of various HOA documents within a specific period of time after the submission of the Purchase Agreement. A suitable rescission period is clearly declared in the Common Interest Community (CIC) disclosures, unless you specifically waive this right of rescission. Please ask your Realtor to explain the details as they might apply to your situation.
  • It requires the seller, not the HOA, to provide the documents to you. The seller would obtain the documents from the HOA but the Purchase Agreement is between you and the seller only. If you were not provided the documents, your issue is with the seller.
