  • The boyfriend is the legal father. As far as not being able to find the husband depending on the state you live in you may be able to do a default divorce. Check with an attorney.
  • The husband is considered the legal father as when you are married, all children born during that marriage are considered to be your husbands. I understand you probably know your boyfriend is the father. What needs to happen first is to locate your husband and file for divorce. This CAN be done. Usually you just need to post your intentions in a newspaper for so many weeks (of course the lawyer tells you what to write) and then if your husband doesn't answer, your divorce is granted. Then your boyfriend will need to get a DNA test to establish paternity. Please do this, simply to protect you. Because down the line, if things don't go like you plan and you and boyfriend split, you will have paternity on file to get child support.
