  • I think we've got federal laws because they haven't been challenged yet. I think Clinton signed DoMA knowing it was probably nakedly unconstitutional, both on full faith & credit and 10th amendment grounds (10th because the fed can't make laws governing practices that have been set aside for the states, or that the fed's never gotten around to taking over). All you need to kill DoMA is a same-sex married couple to file a joint income tax return.
  • Same thing applies to drug laws.
  • I believe to the deepest regrads they are unconsitutional. They violate "full faith and credit".
