  • It's up to the court to determine who gets child support.
  • Was there an order for it in the first place? If not, no child support is owed. When residence changed, there should have been a written agreement that the Mom would now pay suport to the Dad. At the very least, when the 'child' moved back with Mom, the Dad should have had a 'holiday' from child support for an amount of time equal to the time the 'child' lived with him. That is just my opinion, not a legal one, to be sure. You all need a lawyer or go to court to solve this one.
  • Generally yes, but a good lawyer might convince a judge to give him a break considering the circumstances.
