It's up to the court to determine who gets child support.

Was there an order for it in the first place? If not, no child support is owed. When residence changed, there should have been a written agreement that the Mom would now pay suport to the Dad. At the very least, when the 'child' moved back with Mom, the Dad should have had a 'holiday' from child support for an amount of time equal to the time the 'child' lived with him. That is just my opinion, not a legal one, to be sure. You all need a lawyer or go to court to solve this one.

Generally yes, but a good lawyer might convince a judge to give him a break considering the circumstances.
