  • Generally, its not in most places. Unless a statute specifically states so, all crimes have to have both a physical element (the actus reus) and a mental element (the mens rea). If you are not aware that you are committing something that would be a crime if you were aware, then you lack an essential element of the crime. Even when codified, many crimes will reflect this requirement. E.g. where I am (Australia) an example of a "receiving" offence in the NSW Crimes Act is worded thus: Whosoever receives, or disposes of, or attempts to dispose of, any property, the stealing whereof amounts to a serious indictable offence, knowing the same to have been stolen, shall be guilty of a serious indictable offence, and may be indicted, [... snip ...] The use of the word "knowing" or "knowingly" in most offences shows an explicit requirement for the mens rea. Of course governments can and do create offences of strict or absolute liability, where no knowledge is necessary to constitute the crime. However these are generally reserved for very serious offences, such as possession of child pornography, importation of narcotics, etc.
