  • The lawyer who handled your closing should have been aware of this and saw to it that it had a clear title. Go talk to him or her and ask them why they didi not do their job. Mr Bill
  • Unfortunately, this is the most egregious legal practice of the building industry. Even after the home owner has paid the builder and the builder absconds with the funds, the subcontractor can still legally come after the owner for payment. You might be able to get the amount of money owed reduced by a sympathetic business person, but you have no legal recourse other than to pay up.
  • This will vary by jurisdiction, but the title company that closed the transaction should have received lien releases form all subcontractors of record. In some States the lumber company could not lien the property after it had changed hands. Please consult a competent real estate attorney in your area to discuss your options.
