No. Because staplers aren't generally fatal, you'd have no reasonable expectation that you would kill them. With no intent there can be no murder. However they do have manslaughter laws, designed for when, what you do, kills someone without a reasonable expectation of death. So murder no. Manslaughter yes.

Yes, if the person had: 1) the intent to kill, 2) the intent to cause severe bodily harm, or 3) throwing the stapler was done during the commission of an inherently dangerous felony.

It would probably be prosecuted as manslaughter, but certainly charges could be brought.

Yes but in this case I would think they would charge them with aggravated assault and involuntary manslaughter. I mean really who would intentionally try to kill another by throwing a stapler??? Who would believe the person planned this ahead of time with the intent of killing the guy? Would a jury ever be convinced this staple thrower, reseached the best staplers to use for murder, and the staples best to "load" it with, and the most effective way of throwing it so as to result in death by puncture of an aneurysm that they coincidently must have known was there and used this method to kill the guy so it would look accidental....lol Sorry but this scenerio really is absurd...however if OJ can slaughter nicole, get off and end up yrs later jailed for stealing his own stuff then I supposed someone could get life for murder by stapler
