  • There wouldn't be much point in having a jury if they didn't make the decision. However, a judge has a responsibility to direct the jury on points of law, so if there is a point of law that would make a conviction unsafe, the judge would be failing in his duty if he didn't bring this to the attention of the jury. I believe that this is true in any country that follows the British system of jurisprudence.
