If she made an agreement with him to have forced sex then in my opinion there is no sex crime because she consented and she accepted his money and I think that she would have a hard time proving otherwise. However,if she refused the money it would have to depend on her reasons for her to do so, anything could have happened for her to change her mind, he could have become very aggressive and violent so whether she agreed to it in the begining is not the issue, it's the events that actually took place after the agreement was made, so yes a crime could have taken place that led up to her not taking the money thus ending the agreement and her being a prostitute should not mean that her complaint should not be taken seriously, she should have the same protection from the law as anyone else has. My dad is a Barrister and he has sent quite a few men to prison over the years who have raped prostitutes thinking that if they said the woman agreed to it they could get away with it because who is going to believe a prostitute.

You're reading If a hooker charged rape against a man, and in court the man said he wanted a 'rape' deal, so he forced sex with her, and paid her $1k after and she accepted the $ is there a crime other than prostitution? what if she didn't take the$
Comments
I know the Q is a little confusing, he found her and raped her then payed her and if she took the $$ is it still rape, and if she didn't take the cash, would she get justice, being a pro

Thanks for clarification, if he found her and raped her whether he gave her money or not he would have commited a crime, but the question would have to be asked as to why she took the money and she would have to have a very covincing argument as to why she took the money as it could weaken her case because it could be seen as if she consented. If she did not take the money she would have a stronger case and even though she is a prostitute she would be fully protected under the law, the same as any other woman and if found guilty he could go to prison.
