YES If you trusted your dad in their care and they abused your trust by forgetting to take care of him, you should sue. you have a good lawsuit, and nursing homes need to be reminded of how important it is for them to be responsible.

You're reading If your dad died in a nursing home because he fell out of the bed, would you sue? They didn't put the side rails up.

Thanks for your answer. I'm thinking about doing that.

no problem. you should sue, seriously. get an attorney, show the right papers, and present the right case, and no one will be able to find a flaw. (ive got two lawyers in my family, sorry if i sound too serious. its just that... stuff like this makes me mad.)

It makes me mad too. My dad wasn't on his death bed. When he fell out, his foot was wrapped in the sheets and his head hit the floor. I was just with him 3 days prior to that and he was fine.

thats even worse. as i've said... two times now, you should sue. i know how much it hurts and i know that this wont make up for it, but think of how many people you'll help in the long run. as i said, get a good attorney, and present them with your case.
