And once there is a court order, if the father has not been paying support in any way, he might just be ordered to pay retroactively for the period between the separation and the date of the order.

Jeniscool - You can refuse to let a parent who has no legal custody or visitation to visit your child. If there is no court order for visitation, then none is what you can give them.

Always remember if asking or answering legal questions, the laws of that particular country must be taken into account. For example,In Australia the Child Support Agency has the power to peruse and collect support on behalf of the custodial parent.

Ozpaul, surely the Australian Child Support Agency still needs a cour order or a written agreement in order to collect the child support - they can't act all on their own.

Same thing goes here in the US as in Australia. The dept. of child support enforcement can collect child support, but there has to be a support order first. It isn't simply implied that because you have a child, you will receive support (although you ARE legally entitled to it under certain circumstances). You have to pursue the support and have an order put in place.
