Is it true that if your car is turned off before a law officer arrives behind you with flashing lights that you cannot be accused of a moving violation?

    No. If the officer observed your violation technically it does not matter if your car is on or off when he arrives behind you provided that he pursues you immedately. Also, you cannot be out of his view more than 15 seconds or so unless it was something more serious like a hit and run or a high speed chase. In otherwords, he cannot observe you run a stop sign and then pull you over later on in the afternoon and say, "Hey, remember back on Main and 4th street...." But I am sure that there are cases where people have beat the ticket by speeding away from an approaching officer and then parked the car and got out thus making it hard for the cop to prove that they were in the car at the time of the violation.

    • if the officer can i.d. the violator, a traffic citation later is permissible. 15 seconds out view is absurd.

    • Speeding away from the officer gets you a felony evasion charge not out of a class c misdemeanor.
