Unless the website specifically states that it is OK to download and use images from that website, chances are downloading and using them without such permission would constitute copyright infringement. Read permission statements carefully: the permission could be solely for non-commercial use. If you were to use such images on your commercial website, you would still be infringing copyright. When in doubt about an image, request permission from the webmaster of the website in question. If they are unable to grant permission, they would certainly be able to direct you to the person who can grant permission. NOTE: U.S. Copyright Law slaps a Copyright on any new creation by any U.S. Citizen. The creator has to specifically and explicitly release the work into the public domain, or spell out what rights the creator is giving up over the new work (such as with a "Creative Commons" license, http://creativecommons.org/), in order for anyone else to be able to make use of the new work. If the creator put the image on a page without an explicit statement of copyright, but did establish that s/he created the artwork, the copyright /exists/ and is actionable if infringed on by anyone. FURTHER NOTE: Copyright infringement is not limited to "selling copies of the work without permission". If the copier simply hands out free copies of the work (such as on the street, on a non-commercial website, or through filesharing software) and doesn't charge a penny for any of them, s/he is still guilty of copyright infringement as they have just reduced the value of the copyrighted work, or reduced existing sales: why buy a copy from the content creator when you can get a copy for free from the infringer?

In a nutshell... If used to make money, it's not legal without permission. For most other uses, it's fair game.

It is legal unless you take the picture and say that you made it yourself and sell it for money
