If the limb is still on a tree on her property she is responsible, if the tree holding the limb is on your property you are responsible. It does not matter where the limb came from just where it is now.

if you dont want any headaches, just get it done, before it lands on your house and causes more damage. take pictures too, those are always usefull in court, if it goes that far. what ever you do, do it fast before the snow comes in and breaks it more.

First, nobody is responsible to have it cut down. However, I think what you are asking is "can the neighbor be held liable if the limb falls and damages your property"? In most states the answer is that it depends. You are only responsible for damage if you did something wrong that caused the damage. For example, if the wind had knocked the limb down and it damaged your roof, then the neighbor would not be liable because she did nothing wrong to cause the limb to fall. If the limb is currently on your neighbors property, they know about the limb, and it falls, they may be held liable. However, if the limb is on your property (which it sounds like is the case), then you would have to incur any loss that results from not removing the limb.
