If there is a runner on first and a right handed pitcher throws to 3rd that is not occupied to get the runner out trying to steal from first to second, is this a balk? Third throws to second to make the play.

No it's not a balk, its not a smart move, but it is acceptable. I am not sure why he would throw it to third, as opposed to second to get him directly out. Smart move, nope?

If the pitcher is on the rubber, then he has the following options: 1) step off the rubber and become a fielder. 2) Step and throw to first to attempt to retire the runner. 3) If runner is stealing second, pitcher can turn immediately towards second and throw to make a play 4) And of course pitch the ball home. If he throws to third in this situation IT IS A BALK. It is an unoccupied base and there is no play at the base.
