It is the graffiti artist's. You would be stealing it. :)

Copyright is automatic as soon as you create something. However a graffiti artists might have a hard time proving this in court of course, and it would be financially restrictive anyways.

The graffiti is their art, but the picture is yours.

well.depending on what you do with it..you would have to give credit to the graffiti artist..however..if you are taking a photograph..you capture the art in a certain angle..and light..you show a whole new idea with the grffiti included then that is art in itself..there are people who take pictures of streets and parks with monuments and statues..they are the artists because of what they captured and how they captured it
