  • You are not going to find anything under Michigan law or any other state that addresses your question because it literally attempts to combine oranges and apples. By that I mean that there are laws that apply to trusts and there are laws that apply to the probate of a decedent’s estate. The have entirely different application, principles and moreover, different terminology. For instance you write, “the executor of the trust”. But there is no such animal as the executor of a trust. The title of the office responsible for the administration of a Trust is called the Trustee. The duties and responsibilities of a Trustee are spelled out in the instrument that creates the Trust. The duties and responsibilities of an Executor of a decedent’s estate are to administer and distribute the estate in accordance with the testator’s expressed wishes and within the bounds of applicable probable law.
