No. The financial institution cannot talk. An agent of the institution can make representations about the business. In that case, you do have a cause of action if the agent lied and you relied upon the representation to your detriment. Of course, if the institution is insolvent, you would not want to sue them anyway. Even if you win, you would never collect.
