  • In the U.S., yes. The buyer has acquired the property line violation of the previous owner. This is the sort of thing that title insurance is for, in fact: the title insurance company (for a fee) is promising that when you buy a piece of property there is nothing encumbering the title. They should compensate the buyer for anything discovered after the sale that is title related (e.g. your house encroaches the property line, etc.)
