If the house is not listed with an agent, the seller has no responsibility to pay any commission. That would be between the buyer, and the agent who represents the buyer. Commission is payable based upon a contract between two parties, and if the seller does not have a contract, they don't pay. I would strongly suggest that you hire an attorney to handle the closing for you. The sale of a house is probably the largest financial transaction that most of us will make in our lifetimes, and you should have someone involved that is there to protect your interests. Don't rely on the bank's attorney to protect you, as they are there to protect the bank's interest - which may not necessarily be the same as yours.
