  • Two words - caveat emptor. It's Latin, and means let the buyer beware. If you purchase privately you buy sight as seen, and if you miss something there is no warranty like with a limited company. Sorry.
  • There are two exceptions that I know of- 1. the car can be from before when the smog certification law went into effect 2. the Department of Motor Vehicles can declare the car a "classic car" that is exempt from having to be smogged. I drive a 1957 Ford Fairlane 500 that is owned by my mother. I had the car declared smog exempt under both laws just in case one of the laws is repealed.
  • You cannot legally do anything to the private party because you should have checked that out first. Find a crooked smog guy. They're about 150.00.
  • You are stuck in the deal .... as it is a BUYER's responsability to check out those kind of things PRIOR to PAYING for the vehicle .... +5
