CPS usually does not determine an accusation to be false. All they can do is determine that the accusation cannot be substantiated. This is similar to our justice system. A person is not found to be innocent. They are only found to be not guilty beyond a reasonable doubt. You could sue a child for defamation, but you would need to be able to prove the allegations are false.

This has happened to me also. I solved the problem by having my 15 year old son labeled: OUT OF CONTROL in Family Court. This was the Social Worker's recommendation, and I followed it.
