A female driver is observed speeding. the officer pulls her over. the officer is immediately faced with a violate driver that is talking on a cellphone and refuses to talk to the officer. the officer realizes that there is something wrong with the driver, because of her non-willingness to co-operate and disorderly behavior by shouting at the officer. the officer requests her three times to stop talking on the cellphone and to exit the vehicle. driver still refuses. officer then warns driver that she will be tased if she does not exit the vehicle. she is warned three times. driver is now irate. officer then uses his taser to apprehend the driver. Driver is later determined to be high on cocaine. she is charged with driving under the influence and failing to obey the lawful order of a police officer. During the initial stop and before the taser use, the officer did not know the physical and mental condition of the driver. he also did not know if the driver was armed. since the non-willingness of the driver to co-operate, this only heightened the officers defenses of other suspcious activities of the driver. The officer was correct in the use of the taser.
