  • No, you probably can't. In many states, felonies are subject to 3 strikes laws, which substantially increase the penalties if someone commits a similar felony 3+ times. Given that, the state will argue that they have a strong interest in maintaining your son's criminal record, and you won't be able to get it expunged.
  • No. And the courts didn't make him a convicted felon, your son did that himself.
  • You can certainly try! But avallach is right, the courts didn't do this to him, he did it to himself. Before trying though, he should really get his $hit together and be on the up and up. I think what you really need to do is appeal to the governor though, not the court system. During election years alot of governors will do things they wouldn't during other times. They want your vote.
