Did he recently put it there, or was it there when he/you guys moved in? If he put it up without your permission, I'm sure you can make him take it down. If nothing else there's probably something you can file staying "Hey this is my property, I let him put his fence here but it's still my space." (I believe my parents did this with our neighbor's fence, they *wanted* it to be 2-3 inches into our property- so if her dog stuck her snout through the fence and got bit by our dog, her dog would have been on our property. Something like that, has been a while.)

I have a similiar problem. The fence between our properties has been there for 25 years. It's chain link. Both houses have passed through numerous owners. I have lived in my house for 13 years the parties in question have been there 7yrs now they are claiming the fence in on there property by about 18 inches. The properties are apx. 1.5 acres. I planted a beautiful hedge along this fence a couple of years ago that is apx 300 feet long. Any suggestions. sleepless
