If there's no contractual agreement, then of course you can legally them have removed from your home. Just call the police and tell them they refuse to leave and you want them to please leave your residence. Good luck!

First ask the roommate to leave. Be polite, but firm, about it. Give him a reasonable amount of time to find somewhere else to live and to move his stuff out. If he has not moved out in that amount of time, then follow Answers101 suggestion and call the police for help in evicting him. ************ "pilaf153: Thank you guys for the response. I am very willing to give him 30 days notice but my worry was if he refused. You dont think that I would have to take the legal eviction route? I would just have to get the police involved to remove him?" I am not a lawyer. So, I really can't write to the legal aspects of this situation. My answer is more in the the way of advice about the honorable way to handle this situation.

This is a good answer, though you do not have to give the person a "reasonable" amount of time. You could have them leave within 24 hours, unless state law grants specific rights
