I drive a semi and recently got speeding ticket for 67 in 60.truck is governed and can not run that fast.clear driving record.what to say in court and also have black box in truck which states i was only doing 63

You might need a certificate that your speedometer is accurate also. That and your tach chart should be enough to convince the court. Have to hate the inconvenience of all that!!!!! And what a dick for a cop . . . wrote you for 7 miles over? Would be different if you were in a school zone or something and were 7 miles over. Oh well, there's probably lots of times you deserved a ticket and didn't get one. That's how I stay calm about a thing like that.

- I understand that and you are right. Good point. I still think 7 mile over is a bit of a bitch. Is the cop right, sure. The trucker exceeded the speed limit, but in my view he's still a bit of a wanker.

- of course if the officers dont write tickets ,his boss thinks he's not doing his job,so you dont write tickets to locals(they may be related to the judge) you write them to truckers most truckers dont have time to fight them

- You sound like you have the inside track. Sounds totally logical. The same reason out of staters always get stopped on the interstate. I got one in Colorado last summer and I have no excuse. I have cruise control, but I usually keep it set at 10 over because one usually doesn't get a ticket unless more over than that. I'll be changing that habit!

That about says it. You need to present the evidence of your black box and have the speedometer of the truck calibrated. That will tell you if it was off. Together, you should have no problem with this case.

It is easy to argue a speeding ticket if your speedometer was off. You intended (and your instruments told you) to go one speed while actually going another.

- That's actually not bad, I'm 4 for 5 - oddly enough the one ticket that I couldn't get out of was just outside of Atlanta. I think it was the UF license plate that did me in.

- Damn straight it was. i know cops who look for Ohio plates and pull people over for minor infractions.
  I am a horrible driver, but good during cross-x. I subpoena a crap load of records and love telling the judge they haven't been provided!
  I am currently fighting a center turn lane violation. I have had it moved from city to county to state magistrate court. It's a $75 fine, but in Atlanta I can stretch this out for 2 years before paying the fine. God Bless America!

- It does if you think you are going 60, but really going 67. It is a valid excuse in court.

- You can make any excuse you want in court, but it does not legally excuse you for going over the soed limit. You violate the law when you go over the speed limit. Intent is not an element of the crime.

- Judges understand that when you rely on an instrument for a measurement and that instrument fails you that is cause for a reasonable doubt that you not only had no intent, but were unaware that you were speeding. Trust me on this one, judges are not looking to throw the book at speeders when they clearly, through instrumentation failure, did not know they were speeding.
  I have done it before and all three judges dismissed the charges.

- Judges have descretion and some may dismiss the case, but many others won't. My point is simply that the law makes no exception for instrument failure.

download and present as evidence readout from the blackbox,w/ a NOTORIZED statement from your company(if its a company truck)stating that this is the reading from the box on your vehicle.showing time, date speed,rpm,are correct and your truck speedometer has been checked and is correct.ALSO, ask when the last time the officers radar gun was calibrated....
ive driven truck for 28 yrs and ive fought quite a few tickets.if you go to court w/all your evidence,and notorized statements,you will beat it.
