Attorneys who take contingency cases only get paid if they win. Perhaps this attorney doesn't feel you have a strong enough case.

You can talk to another attorney, but if the lawyer is paid on contingency he will pursue your case if he thinks he can win. However, a lawyer cannot file a case if he fails to investigate or thinks the case is unmeritorious. So it is possible he is not filing for a reason.

It is inexcusable for a lawyer (or at least someone from his/her office) not to return your calls and provide you with the status of your case. Speak IMMEDIATELY to another lawyer, as the statute if limitations may expire soon on your right to pursue your claim. Make sure to tell the new lawyer about the other one so he can demand your file from that office.

Have you tried going to his office and INSISTING on seeing him ... then ASK him what is going on ... Once you have done that and you still feel neglected ; you CAN file a complaint with your state Bar Association ...
