  • First I am not a lawyer, please consult a lawyer for best advice applicable to your state and court systems. I'm answering having been there and consulted several lawyers over three states, none TX. (Yeah, it's been in the works a while) In the state I currently reside adultery is actually a misdemeanor, the state I previously lived in was 100% no-fault and the other state was 100% fault and yet I got the same information from lawyers in all 3 states. Adultery may be a factor, mainly for granting the divorce and may sway a little in awarding spousal support. It shouldn't be a huge factor if at all. You'll find there is laws governing the process however there is a lot of leeway for interpretation and application. Much will actually depend on the judge you appear before. Good luck and be strong, this is one process I wouldn't wish even on the mistress. I even told her that.
