its completely up to the officer in all states for this reason.
whether the knife, any knife, or any item, is legal or illegal is secondary to the officers safety and public safety; as the officer sees fit.
you can always go to court and petition for the knife or any other potentially dangerous item back.
but that will probably cost ten times more than the item was worth.
