Sounds like you should give your fiance back the money from the account.

If it was a joint account, how did you close it? I would have expected the bank to require both account owner's permission to close it.

I'm guessing you two have long-since broken off the engagement. You should return any portion that belongs to him.

And he has the legal right to sue you for every last dime in that new account, and most likely will get it too. Why? Because you took a joint account and emptied it and closed it without the joint holder's permission (obviously). In some areas and depending on the circumstances this can be a criminal case. You could be looking at jail time. Your excuse is pretty thin. If you were "worried" about it you could have simply gone to the bank and got an account summery - meaning you could have known without closing the account how much was in there. You took it to levels where it should not have gone, and now a court will have to decide who gets what. Its a joint account, meaning even if you were the sole depositor, he has certain rights too a percentage if not just half of the monies in that account.

I hope you have a good lawyer. You'll need it. Maybe you'll be lucky and the bank will help you work it out with an arbitrator.

if he is doing that then why is he your faincee? i wouldnt want to marry someone who is like that. but you did do something that is silly when you closed the account. if you were worried about the money, then why did you open it as a joint account in the first place?
