As sad as this is going to sound - He's entitled to half - unless you get a kick ass lawyer

Well if it's in your name than he's really entitled to nothing. You'll have the advantage from the get-go in the courtroom, but don't let that fool you, divorces get nasty and I've seen some accusations get tossed around that can reverse property ownership if you get my meaning.

Most states have community property laws which state that any property obtained duting the course of the marriage must divided equally. This would apply regardless of the cause of the divorce Having said that, it would apppear that Ohio is NOT a community property state. He is entitled to an "equitable distribution of the assets." What that means, practically, is the same thing as it does in a community property state. That is, he is entitled to half the marital assets. What is a marital asset? Every dollar earned and all property acquired during the marriage using marital assets. Thus, if you owned the house before you got married, it is yours. If you bought it after you got married (even if it is only in your name), and you bought it with marital assets, half of it is yours. NOTE: Ohio is not a community property state so a judge does not have to split everything 50/50, but the split must be equitable (which usually equates to 50/50).

One of the things that many people don't think about is that it's not the state that you live in, it's the state that you were married in that counts a lot. I was married in Hawaii even though I never lived there. When the divorce started, each of our lawyers told us that the law in Hawaii is that whatever you entered the marriage with is our own and there is no community property for previously owned items. Aside from that, you will probably get 50-60% of everything based on current averages.
