An appellate court necessarily requires an original jurisdiction. Appellate jurisdiction in condemnation proceedings is regulated by a multitude of local statutes, among which there is great diversity and little harmony, and decisions on jurisdiction are but judicial interpretations of these statutory provisions.

In America: The lowest court of general jurisdiction in each state (usually, but not always, called the superior court) generally has no appellate jurisdiction. Some states allow small claims court to be appealed by the defendant to the lowest state court of general jurisdiction, but the court does not review the small claims courts actions, so this is not appellate jurisdiction. At the federal level, the District courts have no appellate jurisdiction.
