I guess what i want to know is if i have DL but i haven't reinstated it could i get out of this ticket

If you have a DL and its suspended, and you are still in posession of the piece of plastic, thats a crime in itself. You could be charged with posession of a suspended DL. Thats why when your license is suspended, you must surrender it to the state. So the answer to your question is no.

In other words, you have been driving on a suspended, revoked or cancelled drivers license. right? In Tennessee, you would have been arrested and taken to jail for the above. If a citation is all you received, you were fortunate. The court may not let you pay the fine. It depends on the circumstances of your inactive drivers license and how they became inactive in the first place.
