Can my 401k fund be given to my 18 year old daughter in the event of a divorce if my spouse doesn't contest it?

    If you mean can you assign your daughter as beneficiary of the account instead of your spouse if he or she agrees to sign the waiver allowing someone else to be the beneficiary then yes.
