  • In most states it is illegal to tape an audio conversation of a person without his or her knowledge.
  • Can they? Yes. Should they? No. They can tape you if they like. However it can not be used against you in a court of law.
  • Hell no! Depending on the laws in your city, the employee could be charged with invasion of privacy and/or wiretapping.
  • You can buy a small digital recorder and a high sensitivity microphone and capture whatever you want. Don't get caught doing it or try to use it in court because it's probably illegal.

  • Depends on where it is, in many places you cannot, and depending on your state laws the person taping may be prosecuted if he/she tries to use it in court. However it is legal in "public" (depending on the cities/states definition of public) because you cannot reasonably expect privacy in public.

  • Sure...you can do it..but you would be breaking the law. This happened to me a couple of years ago. A girl in the office said she had recorded conversations between myself and another girl in the office. When she found out she could go to jail for doing this, she said she had lied and had NOT really recorded us.
  • A phone conversation, between two parties, can be taped by either party. does not matter if its a business or person to person. most businesses will give you a warning that your conversation will be recorded, for whatever reason. The difference is an additional party, like the police. The police must obtain a court order to tape a private conversation between two or more parties, unless it falls under the new Federal Law for National Security.

You may not record a conversation between two other people. Twelve states require, under most circumstances, the consent of all parties to a conversation.
