Only if he had sex with her in a place where the Age of Consent is higher than 16. This seems to be one of the anomalies of US law, where Age of Consent varies from state to state.

I think that when it comes to age of consent there should be one age for the entire country. If 18 is adult then you should only be having sex with adults and anyone under even a week under your treated as any other adult having sex with a child. I truly feel that if the 18 year old can not wait for the child to become an adult then he really does not love her/him.

absolutely not. I think the sex offender issue has got way out of hand. You know if you are caught taking a leak by the side of the road you will have to register as a sex offender? Our prisons are full enough. There needs to be some sense to all this.

No. Many jurisdictions make an exception if both parties are close to the same age exactly to prevent this sort of unfairness.
