  • Yes and no. Your husband's debt stays your husband's debt as far as the creditor is concerned (but if you get divorced, it is possible that you could be liable, but that is a different issue). Generally, the creditor cannot go after your bank account if it is only in your name. However, the creditor can get a court order to access the account if your husband is using your account to hide assets from the creditor. Just because your name is on the account, does not mean than the money is yours. Note: The opposite is true to. If a creditor drains an account, but the money was somebody else's than the debtor, the creditor will have to return the money that didn't belong to the debtor.
