Can an architectural review board decide on a request from a homeowner without the HOA board's approval?

    From whom does the architectural board receive its authority? They have the authority to make such decisions if:
    - The board of the HOA or condominium corporation has given the review board the authority to make such a decision on their own. This is a case of the HOA board voluntarily relinquishing authority.
    - The architectural board is reporting to the municipality and has the legal right to make such a decision to bring a structure into compliance with any building codes or other regulations. This is a case where the HOA board has no authority over the matter.

    Which is what I said when I stated the "board of the HOA or condominium corporation has given the review board the authority". This authority can come through the by-laws of the association, which are upheld by the board, or by authorization granted by the board in an individual case.

    Depends what your bylaws state. But, the board should look over all paperwork, and usually two board members sit on every review committee. And you should go to the board meeting, they must give you at least 48 hours, notification of such. So you can help the process, if it is denied, they also have to tell you why, and let you resubmit.
