  • Maybe, maybe not. If it has been willed to you...yes. If you are the remainderman of a peice of property and there is a life estate there and say perhaps you are the sole remainder and the life tenet passes away then the property is transferred to you. Some property transfers are (non-probatable).
  • 7-9-2017 If anything resembling a will is found, it has to be probated. That is why people say "If you find a will, burn it."
  • I believe in most states, yes. In California property in a trust does not go through probate
